Terms governing our websites, online systems and flat fee or flat rate MLS listing services.

Please read these Terms of Use carefully. These Terms govern your access to and use of SelectPremiumProperties.com, ExpressMLSListings.com and other websites and online services operated by Select Premium Properties, Inc. (“Select Premium Properties,” “we,” “us” or “our”). By accessing a website, creating an account or using our services, you agree to these Terms.
Select Premium Properties, Inc. is the licensed real estate brokerage that provides the MLS listing service. Express MLS Listings is our online marketing and listing platform.
1. Other Agreements
These Terms govern use of the websites and online services. A separate listing agreement and related documents govern the brokerage relationship and the MLS listing for a particular property. Product descriptions, pricing terms, MLS forms and other written agreements may also apply. If these Terms conflict with a signed listing agreement concerning brokerage services, the signed listing agreement controls.
2. Eligibility and Accounts
You must be at least 18 years old, legally able to enter into an agreement and authorized to act for the property owner or entity you identify. You agree to provide accurate, current and complete account information, keep that information updated, safeguard your username and password and promptly notify us if you suspect unauthorized access to your account.
You are responsible for activity conducted through your account. We may require additional information to verify identity, ownership or authority before providing a service or making a material listing change.
3. Electronic Communications and Signatures
You consent to receive agreements, disclosures, notices, listing information, account messages and other communications electronically. Electronic records and signatures may be used to the extent permitted by law. You are responsible for maintaining a working email address and retaining copies of documents and communications important to your listing or transaction.
4. Our Flat Fee MLS Listing Service
Select Premium Properties provides a limited-service, flat fee or flat rate MLS listing. We enter and maintain the property in the MLS selected for the property's location, subject to the signed listing agreement, the rules of that MLS and applicable law.
Unless separately agreed in writing, our service does not include property valuation or appraisal, photography, property preparation, in-person showings, buyer or tenant representation, offer negotiation, legal or tax advice, title services, settlement services, property management, tenant screening or the holding of earnest money or security deposits.
The property owner remains responsible for managing showings, evaluating buyers or tenants, reviewing offers or applications, negotiating terms, making decisions and completing the sale or lease. Optional products and brokerage services may be available separately as described on our pricing and marketing pages.
5. Listing Agreement and MLS Requirements
A written listing agreement is required before any brokerage can place a property in the MLS. Your listing cannot be entered until all required information and documents have been completed and signed.
All listings must comply with applicable laws, Fair Housing requirements, MLS rules, data-entry standards and brokerage policies. We may edit, reject, remove or request revisions to descriptions, photographs, instructions or other submitted material when reasonably necessary for accuracy, legal compliance or MLS compliance. We may also suspend, withdraw or refuse a listing when required information is missing, inaccurate, unlawful or inconsistent with the listing agreement or MLS rules.
6. Your Listing Responsibilities
You agree to:
- Provide truthful, accurate, current and complete property and ownership information.
- Use photographs, descriptions and other materials that you own or are authorized to use.
- Review the completed MLS listing promptly and report any error through the designated form.
- Keep price, availability, showing instructions and listing status accurate throughout the listing period.
- Provide executed contracts, leases, closing information and required status forms within the time stated in the listing agreement, MLS rules or instructions we provide.
- Comply with Fair Housing, disclosure, safety and all other laws applicable to the property and transaction.
- Communicate honestly and lawfully with prospective buyers, tenants and real estate professionals.
MLS fines, penalties, charges or expenses caused by inaccurate information, prohibited content, missed deadlines or a failure to provide required documents may be charged to the property owner as permitted by the listing agreement and applicable law.
7. Listing Review, Changes and Technical Submissions
We make reasonable efforts to enter the information you submit accurately. You are responsible for reviewing the MLS listing and promptly requesting corrections. Listing changes must be submitted through the designated online form so the request is properly documented. Applicable change fees and processing terms are disclosed on the pricing page and in the listing agreement.
You are responsible for using a reasonably current browser, maintaining a reliable internet connection and confirming that forms, photographs and other submissions were successfully received. Please contact us promptly if a technical problem prevents a required submission.
8. Website Syndication
When authorized through the applicable MLS, listing information may be distributed to Realtor.com, Zillow, Homes.com, participating brokerage websites and other real estate websites. Each MLS and independent website controls its own participation, display format, content, update schedule, ranking, archives and removal process.
We do not guarantee that a listing will appear on every website, appear within a particular time, remain in a particular position or display every MLS field. Website destinations and syndication practices may change without notice. We cannot directly edit an independent website that receives its information from the MLS, but MLS corrections will be included in later data feeds according to that website's update schedule.
9. Property Inquiries
Showing requests and agent communications may be delivered through the MLS showing service or contact instructions included with the listing. Buyer, tenant or agent inquiries our brokerage receives about your property are forwarded to the email address you provide. We do not retain those property inquiries to obtain buyer clients or represent the inquiring party.
Independent real estate websites—including Zillow, Realtor.com and others—may offer paid advertising or buyer-lead programs to real estate agents. These websites may display advertising agents, contact buttons, tour-request forms or similar features alongside your listing. A person who uses one of those features may be connected with an agent or service selected by that website rather than with the property owner or Select Premium Properties.
Those advertising and lead-routing features are controlled entirely by the independent website. We cannot remove or alter them, determine where an inquiry submitted through them will be sent or guarantee that we or the property owner will receive it. Our promise to forward property inquiries applies to inquiries our brokerage actually receives.
We do not guarantee the identity, qualifications, financial ability, intentions or conduct of any person who contacts you or requests access to the property. You are responsible for appropriate safety precautions, verification, screening and professional advice.
10. Fees, Payments and Refunds
Current listing fees, closing administration fees, optional-service charges and other potential fees are disclosed on our pricing page and in the applicable listing agreement. You are responsible for reviewing those terms before payment.
Because the primary listing service is performed when we prepare and enter the listing into the MLS, the listing fee generally becomes nonrefundable once the listing has been submitted to the MLS, except when a written guarantee, the listing agreement or applicable law provides otherwise. Optional products, shipping, replacements, cancellations and refunds are governed by the terms presented with the applicable product or service.
11. Client Content and Permission to Use It
You retain ownership of photographs, descriptions and other original content you submit. You grant Select Premium Properties a nonexclusive, worldwide, royalty-free license to reproduce, resize, format, edit for compliance, publish, distribute and transmit that content as reasonably necessary to prepare, advertise, maintain, syndicate and document your listing and provide the services you request.
This permission continues as reasonably necessary for transaction records, legal compliance, MLS archives and previously distributed listing information. You represent that the content is accurate, lawful and does not violate another person's copyright, privacy, publicity or other rights.
12. Acceptable Use
You may not misuse the website or services. Prohibited conduct includes attempting unauthorized account access; disrupting website operation; introducing malicious code; scraping or extracting data through unauthorized automated means; impersonating another person; submitting unlawful, deceptive, discriminatory, defamatory, infringing or harmful material; or using the services in violation of any law, contract or third-party right.
13. Intellectual Property
Except for client content and third-party materials, the websites' design, text, graphics, logos, software and other content are owned by or licensed to Select Premium Properties and are protected by applicable intellectual-property laws. You may use the websites for your personal, lawful use of our services. You may not reproduce, sell, publish, modify, distribute or commercially exploit our website content without prior written permission.
Names, logos and trademarks belonging to MLS organizations, Realtor.com, Zillow, Homes.com and other third parties remain the property of their respective owners. References to third-party services do not imply ownership or endorsement.
14. Third-Party Services and Links
The websites may contain links to, integrate with or provide information from third-party websites and services. We do not control their availability, content, security, privacy practices, prices or performance. Your use of an independent third party is governed by that party's own terms and policies.
15. No Legal, Tax or Financial Advice
Information, forms and resources made available through the websites are provided for general informational or transaction-support purposes and do not constitute legal, tax, financial, appraisal, inspection or other professional advice. Real estate laws and required forms vary by state and transaction. You should consult a qualified attorney, tax professional, inspector, appraiser, lender or other appropriate professional when advice is needed.
16. No Guarantee of a Sale, Lease or Particular Result
MLS entry and website exposure do not guarantee showings, inquiries, offers, a sale, a lease, a particular price or a particular time on market. Results depend on factors outside our control, including property condition, price, location, market conditions, financing, presentation and decisions made by buyers, tenants, agents and independent websites.
17. Disclaimer of Warranties
To the fullest extent permitted by law, the websites, online systems, content and services are provided on an “as is” and “as available” basis. We do not warrant uninterrupted or error-free operation, compatibility with every device, the accuracy of third-party information, the availability of any particular MLS or website destination or the absence of harmful components. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
18. Limitation of Liability
To the fullest extent permitted by law, Select Premium Properties and its owners, officers, employees, contractors and agents will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, lost opportunities, loss of data or business interruption, arising from or related to the websites or services.
To the fullest extent permitted by law, our aggregate liability arising from or related to the websites or services will not exceed the amount you paid to us for the specific product or service giving rise to the claim. These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited.
19. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless Select Premium Properties and its owners, officers, employees, contractors and agents from third-party claims, losses, fines, penalties, liabilities and reasonable costs arising from your submitted content, your management of the property or transaction, your violation of these Terms or the listing agreement, your violation of law or MLS rules, or your infringement of another person's rights.
20. Suspension or Termination
We may restrict or terminate website access, decline a submission or suspend services when reasonably necessary to protect a website or another person, address nonpayment, investigate suspected fraud or misuse, or comply with law, MLS rules or the listing agreement. Termination does not eliminate payment, recordkeeping, indemnification or other obligations that by their nature survive termination.
21. Privacy
Our collection and use of personal information are described in our Privacy Policy. Information intended for an MLS listing will be distributed publicly as described in that policy and the listing agreement.
22. Changes to These Terms or the Services
We may update these Terms or modify the websites and services as our operations, technology or legal obligations change. Revised Terms will be posted on this page with an updated date. Changes apply prospectively when posted unless a different date is stated. Material changes may also be communicated through a website, your account or email when appropriate.
23. Governing Law and Severability
These website Terms are governed by applicable federal law and, except where another law or the signed listing agreement controls, the laws of the state in which Select Premium Properties maintains its principal business office, without regard to conflict-of-law principles. Nothing in these Terms eliminates a consumer right or remedy that cannot lawfully be waived.
If any provision is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
